Scope of work, before and after the 51% membership criteria is achieved:
- Advice all members at least 7 days prior to any Board meetings inviting all members to attend, via email
- Advice all members of any decisions passed through minutes of Board meetings within 14 days of the Board meeting taking place and inviting their comment/s.
- Set up committees and sub committees to share responsibilities among members
- Work with the Managing Agents and/or landlords on long term Cap Ex and yearly Op Ex accounts, discuss analyse and plan the correct long term expenditures for the development and maintain separate accounting structures for long term and annual spending with Managing Agents and landlords
- Organise face to face Section 20 Consultations and discuss and resolve other member issues with Managing Agents and landlords, if necessary and if possible with cooperation from managing agents.
- Organise independent tenders and quotes outside of the remit of any Managing Agents and/or landlords to get an independent appraisal of costs for all Cap Ex expenditure and any Op Ex expenditures requiring an annual spend of more than £10,000, including appointing new Managing Agents if necessary for the improvement of accountability and planning.
- Discuss any members’ rights and obligations relating to the development with the landlords twice a year and update members on the discussions, enforce lease conditions on all leaseholders if necessary via imposing fines through the Managing Agents and/or landlords.
- Challenge any arbitrary decisions made by Managing Agents and/or landlords which may be financially detrimental to members, before the 51% membership criteria is achieved for RTM, through appointing Surveyors and/or through the First Tier (Property) Tribunal.
- Ensuring that the Managing Agents and/or the landlords are reasonable with members in dealing with their day to day queries and day to day operations within the development and holding them to account for services provided and financial management.
